Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services provided by Sales On Track ("Sales On Track," "we," "us," or "our"). By signing up for or using our services, you agree to these Terms. If you do not agree, do not use the service.

1. The service

Sales On Track provides automated call answering, lead qualification, appointment booking, and call summary services for home service businesses. The specifics of your setup — including call scripts, qualifying questions, and scheduling — are configured with you during onboarding and can be updated on request.

2. Fees and billing

Our standard pricing is a one-time setup fee of $500 and a recurring fee of $200 per month, unless otherwise agreed in writing. The setup fee is billed at onboarding. The monthly fee is billed in advance each billing cycle. Fees are non-refundable except where required by law. We may change pricing with at least 30 days' notice; changes will not affect the current paid period.

3. Term and cancellation

Service is provided month to month with no long-term contract. You may cancel at any time, effective at the end of your current billing cycle. We may suspend or terminate service for non-payment or for violation of these Terms. Upon cancellation, we will stop answering calls on your behalf as of the effective date.

4. Your responsibilities

You agree to:

  • Provide accurate information about your business, services, and pricing so we can represent you correctly.
  • Comply with all applicable laws, including call recording, consent, and telemarketing rules in the jurisdictions you operate in.
  • Use the service only for lawful business purposes and not for any deceptive, harassing, or fraudulent activity.
  • Honor appointments and commitments made to your customers through the service.

5. Service availability

We work hard to keep the service running 24/7, but we do not guarantee uninterrupted or error-free operation. The service may occasionally be unavailable due to maintenance, third-party outages (such as telephony or calendar providers), or events beyond our control. We are not liable for missed calls or lost business resulting from such interruptions.

6. Disclaimers

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet every requirement or capture every lead.

7. Limitation of liability

To the fullest extent permitted by law, Sales On Track will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or revenues. Our total liability for any claim arising out of or relating to the service will not exceed the amount you paid us in the three months preceding the event giving rise to the claim.

8. Indemnification

You agree to indemnify and hold harmless Sales On Track from any claims, damages, or expenses arising out of your use of the service, your violation of these Terms, or your violation of any law or the rights of a third party.

9. Changes to these Terms

We may update these Terms from time to time. We'll revise the "Last updated" date above and, for material changes, notify active customers. Continued use of the service after changes take effect constitutes acceptance.

10. Governing law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict of laws principles. Any disputes will be resolved in the state or federal courts located in Missouri.
